Certificate of Conformity

CERTIFICATE OF CONFORMITY

A Certificate of Conformity is issued for each property once the exterior of the home and landscaping has been completed in conformance with the South Down Recreation Association Second Amended and Restated Declaration of Covenants, Restrictions, Easements and By-laws.

Ideally, the Certificate is requested by the new homeowner or builder once the home is completed. The Declaration states in Section 3 (d) that no building or structure may be occupied until a final “Certificate of Conformity” has been issued by the Building Committee (and also signed by a member of the SDRA Executive Council). The Certificate certifies that all buildings, structures and improvements located on the site conform to the approved site plan, landscaping plan and building plan and, in all aspects, have been constructed and is in conformity with the Declaration of SDRA The Certificate of Conformity should be recorded at the Belknap County Registry of Deeds.

Occasionally the Certificate is not recorded at the Registry. When an owner goes to refinance or sell the property, the bank or attorney cannot find a recorded Certificate which is necessary before any further action can be taken. The owner should contact Harvard Management for further information as to how to get a C of C. It is the responsibility of the owner to record the document.
